Job description

Support the ER & Wellness Director in executing the HR Strategy and achieving all Employment Relations output. Provide ER and Wellness high-level administrative assistance to the Business Partners, Line Managers, Shop Stewards, employees and external stakeholders.
Responsibilities:
CCMA
  • Dispute Resolution Management
  • Represent UJ in Conciliations and Arbitrations at the CCMA.
  • Attending referrals and evaluating the disputes, by preparing objections, opposing condonation applications
  • Coordinate pre-arbitration meetings and compile minutes in terms of the CCMA rules
  • Obtain documentary evidence for the proceedings, research case law and establish an angle of defense in line with legislation.
  • Prepare employer bundles and prepare witnesses through consultations.
  • Brief Legal counsel and monitor progress.
  • Coordinate preparation meetings with Legal counsel and UJ witnesses.
  • Monitor implementation of Arbitration Awards.
  • Attend to Rescission applications and other in limine applications.
  • Attend to review applications by consulting with case law and relevant arguments
Collective Bargaining with Unions:
  • Management and high-level coordination of the Collective Bargaining Forum (CBF), identify dates and set a schedule, coordinate monthly meetings as per the annual schedule,
  • Ensure relevant documentation is drafted and circulated to parties in time.
  • Keep record of the proceedings.
  • Coordinate and manage all CBF interventions and training. 
  • Coordinate all trade union Organizational Rights activities.
  • Coordinate Bilateral with trade unions and management.
  • Coordinate and participate in all engagements to implement the Accord entered with NEHAWU.
  • Coordinate the MSA meeting until final agreement.
Providing support in terms of implementing the substantive agreement:
  • Coordinate the Substantive Negotiation meetings,
  • Ensure timeous circulation of the agenda, minutes, and relevant documents and reports relevant to the negotiations process.
Employee Relations:
  • Oversee and ensure the effective management of all ER matters:
    • Management of disciplinary, grievance and incapacity matters in accordance with policy.
    • Monitor timeous preparation of outcome report from disciplinary, grievance and ensure that final decisions are implemented
    • Monitor labour law and employee relations issues and trends in the University and advise what course of action line managers must take where ER advise is needed.
    • Collect evidence and prepare bundle of evidence
    • Evaluate all facts, reports, documents, conditions of service, procedures to ensure consistent application.
    • Refer matters to relevant parties for resolution.
    • Administer the disciplinary records
Management of the Incapacity Forum to diagnose and management of Ill Health within UJ:
  • Management, coordination, advisory and secretariat role within the functionality of the forum. Propose and implement best practices in the management of incapacity cases from start to end.
  • Coordinate and manage monthly meetings, follow up on incapacity matters to ensure compliance and keep record of the proceedings.
  • Ensure timeous circulation of the agenda, minutes and relevant documentation.
ER Training Facilitation and Enabling Leadership:
  • Develop ER training material.
  • Coordinate Training of executives on substantive negotiations.
  • Facilitate Training of line managers on conflict management.
  • Facilitating Training Line managers on ER policies and procedures.
  • Coordinate and Facilitate Trainings on Policies, i.e. grievance, disciplinary and incapacity in Auxiliary services environment for line managers
  • Facilitate Training in respect of level 1 and level 2 disciplinary process for HCMBP’s
Stakeholder Relations:
  • Identify partnership opportunities that will help the Unit to work effectively with HCMBPs, HCM Services, colleagues within the ER unit to achieve institutional goals.
  • Interpret ER policies, guidelines, and procedures to the HCMBPs, staff & line managers.
  • Provide advice to management, staff, trade unions in line with policies & legislation.
  • Provide support and advice to HCMBPs.
  • Review policies and identify gaps, draft and formulate operational documents to assist efficient administration
Service Delivery and Project Management:
  • Interpret ER policies, guidelines & procedures to the stakeholders & providing high level ER advice in all employment matters-Line managers, HCMBPs and staff.
  • Research & advise appropriate processes in line with policies & procedures of the UJ, collective agreements & legislation.
  • Providing support & advice to presiding officers in disciplinary cases regarding policy, regulations & precedents.
  • Management of incapacity cases, advise on Poor Performance & Ill health matters, facilitate enquiry.
  • Providing support with the review process of the UJ Conditions of Service.
  • Identify policies that are due for review and seek input from relevant stakeholders and submit to CBF for consultation.
  • Facilitate Policy Awareness sessions and Advocacy at different campuses to ensure full compliance with policies, relevant legislation and collective agreement reports
Governance and Risk Management:
  • Ensure that an effective filing system is maintained with backups for an effective record keeping system:
    • Timeous submission of reports
    • Compiles and updates the ER case register and ensure accuracy and quality reports.
    • Provide information for ad-hoc reports.
    • Prepare presentations and submit reports and inputs for the ER Forum.
Strategic Employee Relations Projects:
  • Under the supervision of the Director: ER, manage special projects as delegated, as and when required e.g.:
    • Participates at high level to policy review processes
    • Give expert inputs into ER policies
    • Collate relevant documents for such projects 

Minimum requirements

  • Degree in Labour Law or HR or BTech at (NQF 7), with two (2) to three (3) years job-related experience,
  • Experience in Arbitration Representation.
  • Experience in conducting and facilitating training related to Employee Relations.
  • Understanding and working knowledge of all employment relations practices and procedures.
  • Experience in the Higher Education environment is desirable
  • Knowledge of applicable Legislation
  • Understanding and working knowledge of all employment relations practices and procedures
